Thank you for embarking on this new and exciting journey with Body & Data as we discover recent happenings of digital rights issues in Nepal, stay updated with Body & Data's work, and exploring new possibilities and opportunities in digital rights scenarios throughout the globe. We will be together via newsletters 4 times a year.

DIGITAL RIGHTS IN NEPAL

Body & Data has been monitoring selected online and print media outlets on various digital rights issues in Nepal. During the first quarter of the year, we noticed that the Nepal government launched a Beta version of Nagarik App aiming to provide all government services through a single online platform. The PSA however is not clear in how are they going to protect the data of the users and maintain data privacy from within their own system. The government is expanding the digitalization of its services to provide systematic services and control corruption however the question remains how the complex issue such as corruption can be resolved through technological solutions.

The Government of Nepal has drafted a social media management directive. The announcement of the draft was one of the most widely covered news relating to digital security. Experts have said that the new directive is dangerous and threatens freedom of expression for citizens. It also criminalizes social media posts and responses that can be perceived against the government. The government's plan to invest Rs 1 billion to filter 'harmful' internet content.

The political rivalry between the two factions K.P. Oli faction and Prachanda-Madhav faction dissolution of House of Representatives in December 2020 resulted in the creation of Oli's ' Cyber Sena ' which defends him from online criticism.

I n Kathmandu there a protest by taxi drivers against ride-sharing apps, Tootle and Pathao. Seven taxi drivers assaulted a Pathao rider in Kathmandu for allegedly trying to steal customers . For the security of the riders , the company prohibited them from wearing jackets with the company logo. The role of intermediaries in gig-economy in terms of protecting the rights and safety of its workers and users needs wider conversation.

After participating in the Womens' March, part of "Nagarik Andolan", women activists, poets received defamation, trolling, online violence along with death and rape threats from Hindu extremists as to silence the women's voices and resistance. The offline activism can shape online violence and on the other hand, online activities can fuel offline harm and risks.

Happening Soon:

We are so excited to announce that the application for "Kathakaa Kura: Digital Storytelling Workshop for Queer Folks of Nepal" has opened! Apply before May 5th, 2021. Through this workshop, we want to co-create space with queer individuals to choose a story of our lives that we have found influential, and be able to create digital documentation of that story. Our key value behind the digital storytelling workshops is to increase the visibility of queer folks through their stories in digital space and put forward their multiple realities and stories.

Infoshop Details:

We have Infoshop library at our office space! Infoshop is a library space established by Radical Anarco Library + Ris Records + Ladies Mountain League, where people can access radical ideas through flyers, posters, zines, pamphlets and books. It also provides a space to meet other people and in some cases to organise events such as meetings or fund raiser. The library has relocated and decentralised to Body & Data office in Bhaktapur since October 2020 and now is open for your access!

Events:

We organized a workshop called " Feminist Tech Exchange - Digital Security Workshop for Young Women and Queer Folks " where we explored an intersectional approach to understand digital rights along with hands-on sessions on digital security tools.
We organized a virtual discussion on " Privacy in Digital World" in collaboration with Martin Chautari where Rita Baramu from our team spoke on the issue.
We organized a virtual webinar on "Creating Feminist Internet " in collaboration with Martin Chautari where speakers Supriya Manadar, Sarita Lamichanne, and Pallavi Payal along with the moderator Shubha Kayastha spoke on their lived reality on online spaces along with the opportunities, challenges brought by these spaces and how it could be made more accessible, safe and just.
इन्टरनेट स्वतन्त्रता संवाद (Conversation for Internet Freedom) - virtual discussion series where the Social Media Management Directive 2021 was simplified and analyzed.

Campaigns:

We launched a campaign on Data Privacy Day called #PoliticallyPrivate, #गोपनियताकोगफ, where we explored what digital privacy means to young women, queer folks, trans and intersex people, and women with a disability and understand their privacy concerns online and offline.
For "A Guide to Safer Internet Maya", we collaborated with Kanchi ko Awaj to share safer and private sexting practices.
We launched a campaign addressing “ Social Media Management Directives 2021” through twitter threads, memes and virtual discussion, to explore the problems of the directive and its effects on marginalized communities.

हाम्रो यस बडी एण्ड डाटा संगको नयाँ यात्रामा साथ् दिनुभएकोमा धेरै धेरै धन्यबाद! यस त्रैमासिक समाचारपत्र द्वारा नेपालमा डिजिटल अधिकारको क्षेत्रमा के कस्तो भैरहेको छ भनेर जानकारी पाउनु हुन्छ । साथै हाम्रो संस्थाको कामहरु र विश्वभर डिजिटल अधिकारको क्षेत्रमा के कस्तो अवसर र ज्ञानहरु छन् भनेर पनि थाहा पाउनुहुन्छ। हामी यस समाचारपत्रबाट बर्षको ४ चोटी भेट्नेछौ ।

हाम्रो यस नयाँ यात्रा सुरु गर्नुभन्दा अगाडी ध्यान दिनुपर्ने कुराहरु यस प्रकार छन्:

दिजितल अधिकारमा नेपालमा भईरहेका गतिविधिहरु

बडी एण्ड डाटाले निश्चित अनलाइन र प्रिन्ट मिडियाहरुमा प्रकाशित समाचारहरुमध्ये नेपालमा डिजिटल अधिकारको क्षेत्रमा भैरहेका मुद्दाहरुको अनुगमन थालेको छ । यस बर्षको पहिलो त्रैमासिकमा नेपाल सरकारले सम्पूर्ण सरकारी काम कारवाहीहरु एकै अनलाइन थलो मार्फत सम्मपन्न गर्ने लक्ष्य सहित नागरिक एप को बेटा भर्जन (सुरुवाती संस्करण )सार्वजनिक गरेको छ । यधपि यस एपमा प्रयोगकर्ताहरुको तथ्यांकको सुरक्षा र त्यसको गोपनीयता कसरी कायम राख्ने भन्नेबारे भने सरकारी सुचना त्यति स्पस्ट छैन । सरकारले यस्तो खालको डिजिटलकरणलाई अझै बढाउदै सरकारी सेवा सुबिधालाई अझै ब्यबस्थित बनाउने र त्यसमा भ्रस्टाचार नियन्त्रण गर्ने उदेश्य राखेता पनि यस्तो बृहत मुद्धालाई खालि प्रबिधिको मदतले मात्र समाधान गर्न सकिएला त् भन्ने अर्को गम्भीर मुद्धा पनि हामीले ख्याल गर्नुपर्ने हुन्छ । त्यसै गरि सरकारले सामाजिक संजाल ब्यबस्थापन निर्देशिकाको मस्यौदा प्रस्ताब गरेको छ । बिज्ञहरुका अनुसार यस निर्देशिकामा भएका व्यवस्थाहरु नागरिकको अभिव्यक्ति अधिकारको लागि खतरा हुन सक्छ । यसमा भएको प्राबधान अनुसार सरकारी कामहरुको आलोचना गरेका सामाजिक संजालका पोस्टहरुको पनि अपराधीकरण गरिने सम्भावना रहन्छ । सरकाले इन्टरनेटमा हुने 'हानीकारक' सामग्रीहरुलाई फिल्टर गर्न पनि १ अर्ब लगानी गर्ने योजना अघि सारेको छ ।

के. पि. ओलि गुट र प्रचण्ड-माधव गुट बिच राजनैतिक असमझादारी बढ्दा डिसेम्बर २०२० मा प्रतिनिधि सभा विघटन हुन गयो । जसको परिणाम स्वरुप ओलि माथि हुने अनलाईन समालोचनालाई प्रतिवाद गर्नका लागि साइबर सेनाको निर्माण हुन गयो ।

केहि समय अगाडी काठमांडौमा टुटल र पठाओको राइड सेयरिरिङ्ग एपका विरुध ट्याक्सी ड्राइभरहरुले विरोध प्रदर्शन गरेका थिए । सात जना ट्याक्सी ड्राइभरहरुले मिलेर पठाओको राइडरलाई ग्राहक खोसेको निहुँमा हाथपाथ गरेका थिए । यस घटना पछि पठाओले राइडरहरुको सुरक्षाका लागि कम्पनिको लोगो भएको ज्याकेट लगाउन प्रतिबन्ध लगाएको थियो । यहाँनिर गिग-ईकोनोमीका कामदार र ग्राहकको सुरक्षाका निम्ति इन्टरमेडियरिजको भूमिकाबारे विस्तृत रुपमा छलफल हुन जरुरी छ ।

वृहत नागरिक आन्दोलनको महिला मार्चमा सम्हिलित अभियन्ता, कवि र महिलाहरुको आवाजलाई लिएर सामाजिक संजालहरुमा घृणात्मक सन्देस फैलाउने, ट्रोलिंग र अनलाईन दुर्व्यवहार गर्नुका साथै हिन्दुवादी शक्तिबाट व्यक्तिगत रूपमै ज्यान मार्ने र बलात्कारको धम्कि दिने काम भएको थियो। अफलाइनमा हुने अभियानले अनलाइनमा हिंसा, साथै अनलाइनमा हुने गतिबिधिले अफलाइनमा पनि हिंसा हुनसक्छ भनेर देखिन्छ ।

कथाका कुरा: कथाका कुरा - नेपाली क्वेयर व्यक्तिहरुको लागि डिजिटल स्टोरी टेलिंग कार्यशालाको लागि आवेदन खुलेको छ!

यस कार्यशालामा हामीले क्वेयर व्याक्तिहरु आफ्नो जीवनको एउटा महत्वपुर्ण र प्रभावशाली कथालाई डिजिटल माध्यमबाट बनाउने एउटा स्पेसको सह-सिर्जना गर्न चाहन्छौं। यस कार्यशालाले क्वेयर व्यक्तिहरुको अनलाइन स्पेसमा रहेको सहभागिता र प्रतिनिधित्वलाई बढाउनुको संगसंगै क्वेयर व्यक्तिहरुको विभिन्न वास्तविकता र कथाहरुलाई अगाडी ल्याउने उदेश्य बोकेको छ।

हाम्रो अफिसमा अब इन्फोसप पुस्तकालय खुलेको छ! इन्फोशप रेडिकल अनार्को लाइब्रेरी + रिस रेकर्ड्स + लेडीज माउन्टेन लिगले स्थापना गरेको एकपुस्तकालय हो । यहाँ व्यक्तिहरूले, पोष्टरहरू, zines, पुस्तिकाहरू र किताबहरु मार्फत रयादिकल विचारहरूको पहुँच गर्न सक्दछन्। यसले मानिसहरूलाई भेट्न र केहि अवस्थाहरुमा बैठकहरू बस्न वा फन्ड रेजिंग जस्ता कार्यक्रमहरू आयोजना गर्न ठाउँ प्रदान पनि गर्दछ। पुस्तकालय अक्टूबर २०२० देखि भक्तपुर स्थित बडी एण्ड डाटाको कार्यालयमा खुलेको छ र अब तपाईंले यस पुस्तकालयको प्रयोग पनि गर्नसक्नुहुन्छ!

बडी एंड डाटा र मार्टिन चौतारीको सहकार्यमा ' डिजिटल संसारमा गोपनियता ' नामक अनलाईन कार्यक्रममा आयोजना भयो जसमा हाम्रो संस्थाबाट रिता बरामुले आफ्नो विचार राख्नु भयो।
बडी एंड डाटा र मार्टिन चौतारीको सहकार्यमा "फेमिनिस्ट इन्टरनेटको सृजना ' नामक कार्यक्रमको योजना गरि अनलाईन वेबिनारको आयोजना गर्यौं जसमा सरिता लामिछाने , सुप्रिया मानन्धर र पल्लवी पायलले बोल्नुभयो र शुभ कायस्थ सहजकर्ता हुनुहुन्थ्यो। येस् वेबिनारमा उहाहरुले आफ्नो अनलाइन स्पेसमा आफ्नो अनुभवहरु र अनलाइनमा रहेका समस्या, जोखिम, चुनैती र साथसाथै कसरी अनलाइन स्पेसलाई अझ सुरक्षित्, पहुचयुक्त र समान बनाउन सकिन्छ भन्ने कुराहरु पनि गर्नुभयो।
इन्टरनेट स्वतन्त्रता संवाद नामक अनलाइन सम्बाद शृंखलाको मार्चको भागमा हामीले सामाजिक संजाल व्यवस्थापन सम्बन्धि निर्देशिकामा भएको कानुनी र प्राविधिक भाषाहरुको सरलीकरण गर्यौं ।

अभियानहरु:

हामीले डाटा गोपनियताको दिन देखि #PoliticallyPrivate, #गोपनियताकोगफ नामक अभियान सुरु गर्यौं जसमा हामीले महिला, क्वेयर व्यक्तिहरु, पारलैङ्गिक तथा अन्तरलिंगी व्यक्तिहरु र अपाङ्गता भएका महिलाहरुको लागि डाटाको गोपनियता, अनलाइनमा हुने गोपनियता सम्बन्धि चुनौतीहरुको बारेमा बुझ्यौं ।
कान्छीको आवाजसंग मिलेर हामीले " सुकक्षित् इन्टरनेट मायाको लागि उपायहरु" खोज्यौँ जसबाट हामीले सुरक्षित् तरिकाले आफ्नो यौनिक अभिव्यक्ति र डिजिटल यौनिक आनन्द कसरी पाउन सक्छ भनेर जान्यौं ।
टुईटर धागो , मीमहरु र अनलाइन वेबिनारद्वारा हामीले "सामाजिक संजाल व्यवस्थापन सम्बन्धि निर्देशिका" को बारेमा अभियान आयोजना गर्यौं,जसमा हामीले यस निर्देशिकामा रहेका समस्या र सिमान्तिकृत वर्गहरुलाई हुनसक्ने क्षतिको बारेमा पनि कुरा गर्यौं ।

सन् २०१७मा स्थापित यस बडी एण्ड डाटाले महिला, क्वेयर तथा सिमान्तकृत समुदायका व्यक्तिहरुको डिजिटल अधिकारसम्बन्धि बुझाइ र सुचनामाथिको पहुँचलाई बढाउदै लैजाने तर्फ काम गर्दै आएको छ । जहाँ एउटा न्यायिक र सुरक्षित डिजिटल थलोमा उक्त समुदायले आफ्नो अधिकारको अभ्यास गर्न सकुन् भन्ने हाम्रो उदेश्य हो । हामी सुचनाहरुमाथिको पहुँचमा सहजीकरण र नेपाली परिबेशमा डिजिटल अधिकार सम्बन्धि ज्ञान निर्माण र वितरणको माध्यमबाट सबैका लागि पहुँचयुक्त, न्यायिक र सुरक्षित डिजिटल थलो निर्माण गर्ने कार्यमा विभिन्न अभियानहरुसंग हातेमालो गर्दै काम गरिरहेका छौ ।
